Biometric Data and Digital Replica Retention Policy

VCinema LLC, doing business as VCinema Studios. Effective October 20, 2026.

VCinema Studios makes films in which real performers are filmed and, with their consent, their performances may be recast, altered or voiced with AI tools. Some of these tools can create a scan of face geometry or a voiceprint (“biometric data”), and we may make face reference sheets, voice models or other digital replicas of a performer (“replica assets”). This policy explains how we collect, use, keep and destroy them.

1. Consent first

We collect biometric data or create replica assets only after the person has signed a written release that describes the purpose, the specific uses and how long the data is kept. For performers in Illinois and Texas we also give the written notice and obtain the written release or consent that those states require. We do not work with minors’ voices, and we do not clone or convert any minor’s voice.

2. Purpose

We use biometric data and replica assets only to produce the specific project the person agreed to, as described in their release. We do not use them to train AI models beyond that project, and we do not use them in any other project without a new signed agreement.

3. No sale

We never sell, lease, trade or otherwise profit from anyone’s biometric data. We disclose it only to the AI service providers named in the person’s release, for the stated purpose.

4. How long we keep it

We destroy biometric data and replica assets at the earliest of:

  • the end of the purpose for which they were collected (the project and its license term);
  • one year after that purpose ends;
  • three years after the person’s last interaction with us.

For work under a union agreement, we delete replica assets within 90 days of the end of the last permitted use period and certify the deletion in writing. A person can ask us to delete their data earlier for future uses; work already delivered or published remains licensed for its stated term.

5. How we destroy it

We delete the files from our storage and backups, delete any voice model or clone from the AI service where it was made (and never share it to a public voice library), and record the deletion in a destruction log. We confirm deletion in writing to the performer on request, and always for digital-replica performers.

6. Security

We store biometric data and replica assets encrypted, with access limited to the people working on the project, and we opt out of AI vendors’ use of our uploads for training where the vendor allows it.

Project files

  • During a project, we keep two verified copies of your original footage.
  • Your original footage is kept through a 30-day revision window after delivery, then deleted, unless you buy archiving ($150 per TB per year, 1 TB minimum, paid in advance).
  • Masters, delivered finals and project files are kept for 1 year after delivery, or until the end of your archiving term if that is later.
  • Working files are deleted at closeout, once the masters archive is verified and you’ve confirmed your download.
  • Delivery copies are deleted only after you confirm your download.
